Local Committee’s Decision to Reject Urban Renewal Plan in Bat Yam Overturned – An Achievement for Our Firm

Our firm represented Mul HaShdera Initiation and Development Ltd. in an appeal against a decision of the Bat Yam Local Planning and Building Committee to reject an urban renewal plan submitted by the company for Independence Boulevard, at the corner of Uziel Street in Bat Yam.

The rejection of the plan was based on the argument that it did not comply with the city’s updated urban renewal policy. During the appeal hearing, the Appeals Committee endorsed a settlement reached between the parties upon its recommendation, pursuant to which the Local Committee’s decision to reject the plan was revoked, and it was agreed that the Local Committee would re-examine the plan following further discussions between the parties.

During the hearing, the Chair of the Appeals Committee noted that the documents underlying Bat Yam’s comprehensive urban renewal plan do not meet the criteria established in case law for the application of policy, and that they cannot be regarded as documents that a reasonable person could rely upon.

The Chair further recorded in the hearing protocol that the Local Committee had taken note of the Appeals Committee’s remarks, according to which, at this stage, the documents do not meet the criteria set by case law for the implementation of policy, and that the Local Committee intends to take steps to address the situation.
