Our firm represents Bazan Group before the National Planning and Building Council regarding emergency reconstruction measures following the “Am KeLavi” operation

Our Planning and Zoning Department, led by Adv. Yacov Cohen and Adv. Tamir Tabib, is representing Bazan Group (Oil Refineries Ltd.) before the National Council for Planning and Building in a precedent-setting matter: securing an exemption order that would release the company from the need to obtain standard building permits for urgent reconstruction works at its facilities, which sustained heavy damage during the “Am KeLavi” operation.

During the operation, Bazan’s facilities in the Haifa Bay area were hit by Iranian missile fire, causing extensive damage and a significant shutdown of operations. In order to restore the damaged infrastructure and resume activity critical to Israel’s energy sector, the company required immediate regulatory approval to carry out demolition and reconstruction works.

While such work typically requires a full permitting process, our firm advised Bazan on a regulatory solution under the Planning and Building Law. Following our request, and based on a legal analysis by Adv. Cohen and Adv. Tabib, a special exemption order was drafted – allowing the works to proceed without a formal permit.

After deliberation, the National Council recommended to the Minister of Interior to sign the exemption order, excluding the area relating to power-generating turbines, which will be reviewed in a separate hearing.
