Our firm’s Planning and Construction department registered another significant achievement in favor of Shapir Industries Ltd., concerning the establishment of the light rail green line in Jerusalem.
The Jerusalem District Court dismissed an appeal permission application – submitted on the Magistrate Court decision – to postpone the request for an injunction against works to establish a organizational site that includes a shapir concrete factory, claimed to being done without a permit and unlawfully.
The District Court accepted our position that the works performed by shapir fall under the exemptions determined by section 261(d) of the Building and PLanning Law and section 27 of the Building and Planning Regulations (workds and structures exempt from permits) 2014 – and rejected the application while charging the appellants with legal expenses.
This is a precedential case wherein both the Magistrate Court and the District Court accepted our legal standing that the works accompanying construction works fo the light rail, which were performed outside of the light rail planned area, can be carried out without a building permit or a permit for irregular use.
