Adv. Shani Marom, Partner in our Labour & Employment Department, participated in the Dun’s 100 Forum for senior legal professionals, discussing the evolving realities of the labour market.
Moderated by Gideon Oko (Channel 12 News), the forum addressed issues employers face today, including the use of AI tools in recruitment, performance evaluation and monitoring; the Protection of Employees in Military Reserve Service Law; returning to reserve duty from a hybrid workplace; and more.
Adv. Marom addressed the use of AI tools:
“In today’s labour market, artificial intelligence is fundamentally transforming how organisations recruit, assess and manage employees. AI systems are now embedded in nearly every stage – from CV screening and video interviews, to tone-of-voice and body-language analysis, and even decisions regarding promotion or dismissal.
Alongside its benefits – speed, accuracy and reducing the burden on HR teams – AI also brings significant legal and ethical risks.Even when recruitment decisions are made automatically, legal responsibility remains with the employer. The Equal Opportunities in Employment Law applies equally to AI-driven decisions, making human oversight essential, along with documenting reasons for each decision and maintaining transparency towards candidates.
Once an employee is hired, using AI to evaluate performance or make dismissal decisions requires particular caution. When recommendations rely solely on statistical data, without human review or a genuine hearing process, there is a real risk of infringing the employee’s right to due process and of unlawful termination.”
