Among other things, the defendant claims that the plaintiff’s claims are unfounded, angular and lacking any foundation, and that the claim in one of intimidation, aimed at preventing healthy competition for the benefit of the public, since indeed, the investment methods and terms “issuer ceiling” and “margin factor” are generic, familiar and well-known terms and methods, which were referenced explicitly, inter alia in various studies and articles, in which indices and funds were used long before the plaintiff introduced its indices in the Israeli market. These terms and methods are recognized both in Israel and around the world, they are not unique and the index has no ownership of them.
