Adv. Shani Marom, Partner in our Labour and Employment Department, participated in the Dun’s 100 Labour and Employment Law Forum, which brought together partners from leading law firms to discuss key issues affecting the labour market.
During the discussion, Adv. Marom, who primarily represents employers, addressed the issue of employees submitting sick leave certificates shortly after receiving an invitation to a pre-dismissal hearing, and the managerial and legal challenges that arise when hearings are repeatedly postponed due to sick leave.
Adv. Marom outlined the tools available to employers in such circumstances, including documenting the relevant facts, considering alternative arrangements for conducting hearings and examining exceptional circumstances, all in accordance with applicable law and with due regard for employees’ privacy and rights.
She emphasised:
“Protecting employees who are genuinely ill is essential, but employers must also have the tools to address well-founded concerns about the misuse of sick leave certificates. The challenge is to enable employers to manage their businesses and proceed with legitimate processes without infringing upon employees’ rights.”
