The Haifa Enforcement and Collection Authority (Deputy Registrar Hon. Efrat Lerner) recently issued an important ruling, rejecting a financial institution’s request to immediately sell a couple’s residence in Tel Mond, despite a temporary lien placed on the mortgaged property.
The Registrar held, inter alia, that a temporary lien does not justify the severe measure of selling a family home so long as the mortgage payments are being duly made. The decision emphasised that “a temporary lien does not justify causing such heavy damage to the family,” placing the right to housing and family stability above unnecessary drastic steps.
